Terms of service
These terms govern use of the CarDesk service provided by: [Legal name, company form, VAT no., GEMI no., registered address], Athens, Greece ("CarDesk", "we"). By creating an account you accept these terms on behalf of your dealership ("Customer").
1. The service
CarDesk is software as a service (SaaS) for professional car salespeople: lead capture, AI drafts and automated messages over SMS, email and WhatsApp, an inbox, follow-up sequences and compliance tools. The service is for businesses only, not consumers.
2. Account
The Customer is responsible for the accuracy of its details, for keeping passwords confidential and for all actions of its users. Tell us immediately about any unauthorised use.
3. Acceptable use and responsibility for messages
The Customer is the controller of its lead data and the sender of the messages. It agrees:
- to have a lawful basis (e.g. consent) for every communication, under the GDPR, the ePrivacy rules (Greek Law 3471/2006) and the providers’ terms (Twilio, WhatsApp, Brevo);
- not to send spam, misleading or unlawful content and not to bypass the compliance checks;
- to review AI drafts and automation settings; AI can make mistakes;
- to honour opt-out requests (STOP) and data subject rights.
We may suspend sending or accounts that breach these terms or put the service at risk.
4. Prices, trial and payment
Subscriptions are charged per salesperson, monthly in advance, through Stripe, according to the price list. Prices exclude VAT. Paid plans include a 14-day free trial. You may cancel at any time; cancellation takes effect at the end of the current billing period without a refund for the remainder. Price changes are announced at least 30 days ahead.
5. Data
Customer data belongs to the Customer. We process it under the Data Processing Agreement (DPA), which forms part of these terms, and the Privacy policy. After termination you can export your data within 30 days; it is then deleted.
6. Availability
We use reasonable efforts to keep the service highly available, but it is provided “as is”. Message delivery depends on third-party providers and telecom networks.
7. Intellectual property
The CarDesk software, brand and content belong to us. You receive a non-exclusive, non-transferable licence for the subscription term.
8. Limitation of liability
To the extent permitted by law, our total liability is limited to the amounts paid in the previous 12 months and we are not liable for lost profits or indirect damages. This limit does not apply to wilful misconduct or gross negligence.
9. Term and termination
These terms apply for the duration of the subscription. Either party may terminate for a material breach not cured within 15 days of notice.
10. Governing law
Greek law applies. The courts of Athens have jurisdiction.
